1. About us and these terms
1.1 These terms apply when you buy a licence for HD Safeguarded Images (the Plugin). The Plugin is made by Highrise Digital Ltd, a company registered in England and Wales with company number 09989726, whose registered office is at [registered office address] (we, us, our).
1.2 You can contact us at support @ highrise.digital.
1.3 By completing a purchase you agree to these terms. Please read them before you buy. If you are buying on behalf of a school, trust, business or other organisation, you confirm you have authority to accept these terms for it, and you means that organisation.
1.4 Some parts of these terms apply differently depending on whether you are a consumer (an individual buying wholly or mainly outside your trade, business, craft or profession) or a business customer (anyone else, including schools, academy trusts, charities and public bodies). Where a clause applies to only one of these, it says so.
1.5 In these terms:
- Licence means a paid annual licence for the Plugin, giving access to updates and support for a set number of sites.
- Licence Key means the key issued to you to activate the Licence on your sites.
- Licence Period means the 12 months from purchase, and each 12-month renewal period after that.
- Site means a single WordPress installation on a single domain. Local, staging and development copies of a licensed Site do not count towards your limit.
2. The Plugin and your Licence
2.1 Open source code. The Plugin’s code is released under the GNU General Public License, version 2 or later (GPL). Nothing in these terms limits the rights the GPL gives you over the code itself. If anything in these terms conflicts with the GPL in relation to the code, the GPL wins.
2.2 What you are paying for. Your Licence gives you, for the Licence Period and for the number of Sites in your plan:
- access to Plugin updates, including new features, bug fixes and security fixes, delivered through your WordPress dashboard;
- support from us, as described in section 6; and
- a Licence Key to activate the Plugin on your Sites.
2.3 Site limits. You may activate your Licence Key on up to the number of Sites in your plan (1, 3, 10 or 25). You can deactivate a Site and use the activation on another Site at any time. If you need more Sites you can upgrade your plan.
2.4 Licence Keys are personal to you. You must not share, publish, resell or give away your Licence Key, or use it on more Sites than your plan allows. If you do, we may suspend or end your access to updates and support under section 9.
2.5 Our name and brand. The GPL covers the code, not our trade marks. You may not use the name “HD Safeguarded Images”, “Highrise Digital” or our logos to market a copy or fork of the Plugin without our written permission.
2.6 Agencies building for clients. If you buy a Licence to use on client sites, you remain our customer and are responsible for those sites.
3. Buying a Licence
3.1 We sell Licences directly. Licences are sold by us through this website. Payments are processed securely by Stripe, and we do not see or store your full card details. Receipts and VAT invoices for each payment are available in your account on this store.
3.2 Prices. Current annual prices are:
| Plan | Sites | Price per year |
|---|---|---|
| Single | 1 | £99 |
| Small | 3 | £179 |
| Medium | 10 | £349 |
| Large | 25 | £599 |
All prices excludes VAT / taxes. The price you pay is the one shown at checkout when you order. We may change prices for new purchases at any time, and for renewals as set out in section 4.
3.3 When the contract starts. The contract between you and us starts when we confirm your order by email. Your Licence Key is issued straight away and your first Licence Period starts on that date.
4. Renewals and cancellation
4.1 Your Licence renews automatically. At the end of each Licence Period your Licence renews for another 12 months, and we charge the payment method you used, unless you cancel before the renewal date.
4.2 Reminders. We will email you at least 7 days before each renewal, reminding you of the renewal date, the amount you will be charged and how to cancel.
4.3 How to cancel. You can turn off automatic renewal at any time from your account. Cancelling stops future renewals. You keep updates and support until the end of the Licence Period you have already paid for.
4.4 Renewal price changes. If we change the price of your plan, we will tell you at least 30 days before your next renewal. If you do not want to pay the new price, you can cancel before the renewal date.
4.5 Failed payments. If a renewal payment fails, we may retry it. If it still cannot be taken, your Licence will lapse.
4.6 What happens when a Licence lapses. If your Licence is cancelled or not renewed:
- the Plugin keeps working on your Sites with the version you have installed;
- you will no longer receive updates, including security fixes, or support; and
- you can renew at any time to restore updates and support from the date you renew.
Running an out-of-date Plugin is your choice and your risk. We strongly recommend keeping an active Licence so you receive security and compatibility updates.
5. Refunds
5.1 14-day money-back guarantee (all customers). If you are not happy with the Plugin, you can ask for a full refund within 7 days of your first purchase. Email us with your order number. We do not need a reason, though feedback helps us improve. When we refund, your Licence Key is deactivated and you will stop receiving updates and support.
5.2 Upgrades. If you upgrade to a larger plan, we will charge you the difference on a pro-rata basis. Refunds of upgrades follow section 5.1, counted from the date of the upgrade.
5.3 Consumers: your legal right to cancel. If you are a consumer, the law normally gives you 14 days to cancel a contract for digital content. Because the Plugin and Licence Key are supplied to you immediately, at checkout you will be asked to agree to immediate supply and to confirm you understand that your legal right to cancel ends once supply starts. Our money-back guarantee in section 5.1 still applies, so in practice you lose nothing by this.
5.4 Consumers: your other legal rights. If you are a consumer, the Consumer Rights Act 2015 says the Plugin must be as described, fit for purpose and of satisfactory quality. If it is not, you may be entitled to a repair or replacement, or to some or all of your money back. Nothing in these terms affects those rights. Citizens Advice can explain your rights in more detail.
5.5 How refunds are paid. Refunds are paid to the payment method you used, normally within 14 days of our agreeing the refund.
5.6 Abuse. We may refuse a refund under section 5.1 or 5.2 if we reasonably believe the guarantee is being abused, for example repeated purchase-and-refund cycles. This does not affect a consumer’s rights under section 5.5.
6. Updates and support
6.1 Updates. While your Licence is active you will receive every update we release for the Plugin. We aim to keep the Plugin compatible with the current and previous major versions of WordPress and with supported versions of PHP, as stated in the Plugin’s readme. We do not promise to release updates on any schedule, to add any particular feature, or to keep the Plugin compatible with every theme, page builder, plugin or browser.
6.2 How to get support. Support is via our support form. We aim to reply within 1 working days, Monday to Friday, 9am to 5pm UK time, excluding UK bank holidays. These are targets, not guarantees.
6.3 What support covers.
- Help installing, activating and configuring the Plugin.
- Help with how the Plugin’s settings and features work.
- Investigating and, where we can reasonably do so, fixing bugs in the Plugin.
- Reasonable guidance on conflicts with themes, page builders or other plugins.
6.4 What support does not cover.
- Customising the Plugin or writing custom code, CSS or filters for you.
- Fixing problems caused by other software, your hosting, caching or security setup, or changes you have made to the Plugin’s code.
- General WordPress, hosting or website support.
- Old versions of the Plugin when a newer one is available. We may ask you to update first.
- Sites that are not covered by an active Licence.
6.5 Access to your site. We will not ask for your passwords by email. If we need access to diagnose a problem, we will agree a secure method with you, and you remain responsible for removing that access afterwards. Please do not give us access to any personal data we do not need.
6.6 Bespoke work. Customisation, installation for you, or consultancy is not included in a Licence. We are happy to quote for it separately.
7. What the Plugin does, and what it cannot do
7.1 Please read this section carefully before you buy. The Plugin is a deterrent. It makes it harder for visitors to capture or save images from your website. It does not and cannot stop images being copied, and you must not rely on it as your only safeguard.
7.2 What the Plugin is designed to do. In supported desktop browsers, the Plugin is designed to:
- blur or hide images on the page when it detects common screenshot or screen-capture actions, such as the browser window losing focus, the PrintScreen key, or the macOS screenshot shortcut;
- hide images when the page is printed;
- disable right-click saving and dragging of images; and
- show a safeguarding notice to the visitor.
7.3 What the Plugin cannot do. No website software can fully prevent images being copied. In particular, the Plugin does not prevent:
- screenshots or screen recordings taken on mobile phones or tablets;
- photographs of a screen taken with a phone or camera;
- images being downloaded by bots, scrapers, crawlers or other automated tools;
- images being accessed through browser developer tools, page source, browser caches, RSS feeds, image URLs or other copies of your content;
- capture by screen-recording software, browser extensions, remote-desktop or other tools that do not trigger the Plugin’s detection; or
- copying by anyone who is determined to do so.
7.4 Detection is not perfect. The Plugin relies on signals that browsers and operating systems provide. These differ between devices and change over time, so the Plugin may not blur images in every case where a capture is attempted. It may also blur images when no capture is happening, for example when a visitor switches to another window.
7.5 No guarantee. We do not guarantee that the Plugin will prevent any image, or any person in an image, from being copied, shared, published or misused. We do not guarantee that the Plugin will work with every theme, page builder, plugin, browser or device. Except for the rights consumers have under section 5.5, the Plugin is provided on that basis.
7.6 Try before relying on it. We recommend you test the Plugin on your own Site, with your own theme and the devices your visitors use, during the 3-day money-back period.
8. Your responsibilities
8.1 Safeguarding stays with you. You are solely responsible for deciding which images to publish on your Site and for your own safeguarding policies and practices. The Plugin is a supporting tool and does not replace them. In particular, you are responsible for:
- obtaining and recording any consent you need from the people shown in your images, or from parents or carers where the person is a child, and respecting any withdrawal of consent;
- not publishing images of anyone, especially children, whose image should not be online, for example because of a court order, a child-protection plan or a lack of consent;
- deciding what other measures to take, such as publishing images at modest sizes, removing location and other metadata (EXIF data), not naming people in identifiable photos, and password-protecting or restricting access to sensitive galleries; and
- removing images promptly when you need to.
8.2 Data protection. Images of identifiable people are personal data. You are the controller of any personal data you publish on your Site, and you are responsible for complying with the UK GDPR, the Data Protection Act 2018 and any guidance that applies to you, such as Department for Education or Information Commissioner’s Office guidance for schools. We do not process the personal data in your images on your behalf.
8.3 Data we collect. The Plugin does not send your images or your visitors’ personal data to us. We and our payment provider process your account, billing and licence details. When you activate your Licence Key, we collect basic information about your Site (such as its URL and WordPress and PHP versions) to manage your Licence and deliver updates. Our privacy policy explains how we use your information.
8.4 Your Site. You are responsible for keeping backups of your Site, keeping WordPress, your theme and other plugins up to date, and testing updates before applying them to a live Site.
8.5 Telling visitors. The Plugin shows a notice to visitors when it blurs images. You are responsible for the wording of that notice and for making sure your website accurately describes how you protect images. You must not tell parents, staff, pupils or others that the Plugin prevents images being copied.
9. Acceptable use, suspension and ending your Licence
9.1 You must not:
- share, publish, sell or give away your Licence Key, or use it on more Sites than your plan allows;
- try to get around licence checks to receive updates or support you have not paid for;
- use the Plugin, our support or our name in connection with any unlawful activity, or on any site that publishes unlawful content;
- describe the Plugin to others as a guarantee that images cannot be copied; or
- abuse, harass or threaten our staff. We will always treat you with courtesy and ask the same in return.
9.2 What we can do. If you seriously or repeatedly break section 9.1 or these terms, we may suspend or end your access to updates and support, and deactivate your Licence Key. Where the problem can be put right, we will first ask you to do so and give you a reasonable time. If we end your Licence because you have broken these terms, you will not be entitled to a refund, except where the law says otherwise.
9.3 If we stop selling the Plugin. If we decide to stop selling or supporting the Plugin, we will give you at least 60 days’ notice. We will refund the unused part of your current Licence Period on a pro-rata basis. You can keep using the version you have under the GPL.
9.4 After your Licence ends. Sections 7, 8, 10 and 11 continue to apply after your Licence ends.
10. Our liability to you
10.1 What we never exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
10.2 Images copied despite the Plugin. Section 7 explains that the Plugin cannot stop images being copied. To the fullest extent the law allows, we are not responsible for any loss, harm, claim or complaint arising from an image or other content on your Site being captured, copied, downloaded, shared, published or misused by anyone, whether or not the Plugin was active at the time.
If you are a business customer
10.3 Except as set out in section 10.1, we will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any:
- loss of profits, revenue, business, contracts or anticipated savings;
- loss or corruption of data, or website downtime;
- loss of goodwill or damage to reputation;
- fines, penalties or regulatory action, including by the Information Commissioner’s Office, Ofsted or any other regulator;
- claims made against you by third parties, including parents, carers, pupils, staff or members of the public; or
- indirect or consequential loss.
10.4 Except as set out in section 10.1, our total liability to you for all claims arising out of or in connection with your Licence and the Plugin in any 12-month period is limited to the total fees you paid for your Licence in the 12 months before the event giving rise to the claim.
10.5 Except as expressly stated in these terms, all warranties, conditions and other terms implied by statute or common law are excluded to the fullest extent permitted by law.
If you are a consumer
10.6 The Plugin is for use on websites. If you use it for any commercial, business or resale purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
11. General
11.1 Changes to these terms. We may update these terms from time to time, for example to reflect changes in the law or in how we sell the Plugin. The version in force when you buy or renew applies to that Licence Period. If we make a significant change, we will email you before your next renewal, and you can cancel before it if you do not agree.
11.2 Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at our hosting or payment providers, or changes made by browser or operating system makers that stop the Plugin’s detection working. We will tell you and do what we reasonably can to limit the effect.
11.3 Transfer. We may transfer our rights and obligations under these terms to another organisation, for example if the Plugin is sold. We will tell you if this happens and it will not reduce your rights. You may transfer your Licence only with our written agreement, which we will not unreasonably refuse.
11.4 Entire agreement (business customers). If you are a business customer, these terms are the whole agreement between us about the Licence and replace anything said or written before. You have not relied on any statement that is not set out in these terms.
11.5 Third parties. No one other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
11.6 If part of these terms is invalid. If a court decides that any part of these terms is invalid or unenforceable, the rest continues to apply.
11.7 Not enforcing straight away. If we do not insist straight away that you do something you are required to do, or we delay taking action, that does not stop us doing so later.
11.8 Complaints. If you have a complaint, please email [support email address] and we will try to resolve it quickly.
11.9 Governing law and courts. These terms are governed by the law of England and Wales. If you are a business customer, the courts of England and Wales have exclusive jurisdiction over any dispute. If you are a consumer, you may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home country, and you keep the protection of any mandatory consumer law where you live.
